NEW TERMS & CONDITIONS FOR BREEDING
TO "DE NIRO" AND "FIDERTANZ" AS PER MARCH 1, 2011

Due to a preliminary injunction obtained by the Burkhard Wahler Breeding Station (joint owner of the stallions De Niro and Fidertanz), we are not permitted to offer the stallions De Niro and Fidertanz under our new, breeder-friendly settlement terms.

We are sorry that especially in these times, which are difficult for breeders, we must reinstate the old rule for settlement (see below) for the two stallions, De Niro and Fidertanz. We shall continue to try to make an arrangement so that our new, breeder-friendly settlement terms apply to De Niro and Fidertanz as well.


The stud fee and ancillary costs must be remitted at the latest 7 days after receipt of the invoice; a live foal guarantee cannot be given.

In the case of mares that are not in foal or have resorbed, 50 % of the paid stud fee will be credited toward the following breeding season if a veterinary certificate stating that the mare is not in foal is presented by October 1st of this year. If we do not receive this certificate by the deadline stated, we will not credit the amount.

In the case of mares that are inseminated for the first time after July 1st of the respective year which do not come in foal, 100 % of the paid stud fee will be credited toward the following year if a veterinary certificate stating that the mare is not in foal is presented by October 1st of the year.

A refund of the stud fee credited for mares not in foal will not be given.

TERMS & CONDITIONS FOR BREEDING –
EXECPT FOR "DE NIRO" AND "FIDERTANZ"

All breeders that use the services of Böckmann Pferde GmbH acknowledge the following Terms & Conditions as well as the Terms & Conditions for Breeding and Insemination issued by the respective Verband.

The breeding season begins on January 1st and ends August 15th.  

Semen that is to be shipped the same day must be ordered by 9:30 a.m., giving the following information:

· Name of desired stallion
· Name and complete address of the mare owner
· Complete information on the mare (name, pedigree, life number)
· Shipping address

If a mare is to be used for an embryo transfer, this must be stated before each insemination. If we are not told that an embryo transfer will take place, each insemination will be invoiced twice.

Breeding certificates (Deckschein) must be submitted to the stallion keeper at the beginning of the breeding season; do not give these certificates to the veterinarian.

As an approved EU insemination station, Böckmann Pferde GmbH is permitted to send fresh semen from our stallions when ordered. The costs for shipping semen will be invoiced separately. Ask Böckmann Pferde GmbH for a price quotation in advance.

Shipment abroad is possible from Monday to Thursday. When shipping semen abroad, an additional charge of 18.00 Euros will be made for a certificate issued by the German Veterinary Control Board. When the stallions are at shows, frozen semen will be used. Stallions that have qualified for the Bundeschampionat will not be available for breeding after August 1, 2011. The special Terms & Conditions for Frozen Semen are available from Böckmann Pferde GmbH upon request.

Liability will not be assumed for damage during transport. The breeding station must be immediately informed of claims by the following day. Otherwise, the transport will be invoiced. 

After the mare is inseminated, the signed semen usage form along with the Styrofoam box must be returned to Böckmann Pferde GmbH, postage paid; otherwise a charge of 20.00 € will be made for each Styrofoam box. 

As of the breeding season 2011, the following Terms & Conditions apply for the stallions stationed when inseminating for the first time:

· An advanced payment of 300.00 Euros is due at the first insemination. This term applies for every stallion. The remaining stud fee will be invoiced 60 days after the last insemination. The prices of the respective stud fee for each stallion are found on the respective page in our stallion catalogue. When inseminating for the first time after July 1st, the advanced payment of 300.00 Euros will be credited to the following breeding season if the mare does not come in foal.

· The second payment is not due for mares that are not in foal as long as a veterinary certificate stating that the mare is not in foal is presented by September 1, 2011. If the necessary certificate is not presented by the deadline, the entire stud fee must be paid. Breeding certificates (Deckschein) will only be issued after payment has been made in full.

We offer a breeder-friendly rebate system:

· As of 2 mares, the owner of the mares will receive a 10% rebate.
· As of 3 mares, the owner of the mares will receive a 15% rebate.
· As of 4 mares, the owner of the mares will receive a 20% rebate.

Mares are boarded at the risk and on the account of the owner. The daily rate is 8.00 Euros; for mares with foals 10.00 Euros. A charge of 6.00 Euros will be made for mares without a foal on pasture.

Dr. Ute Pansegrau and Dr. Jan Hein Swagemakers are responsible for veterinary services at the station. A cervical culture is required for mares that are not in foal. Boarding is at the risk of the owner. The owner of the mare agrees that a veterinarian and a farrier may be called in at his/her cost if the stallion keeper deems this necessary.

When the mare is delivered or when semen is ordered, the customer acknowledges Böckmann Pferde GmbH's Terms & Conditions for breeding. The place of performance and venue is the domicile of the stallion keeper for all present and future claims arising from this business transaction. 


All prices include the presently valid value added tax rate.
